Dear Congressman Min,
On behalf of the Korean American Vietnam War Veterans Association SW Region, I respectfully request your assistance regarding the continued lack of meaningful benefits for Korean American veterans who served alongside United States forces during the Vietnam War.
The Korean American VALOR Act (H.R. 366) became Public Law 118-20 on November 13, 2023. This landmark legislation was intended to expand eligibility for certain Department of Veterans Affairs health care benefits to veterans of the Republic of Korea Armed Forces who served in Vietnam.
More than two and a half years have now passed since the law was enacted. Yet Korean Vietnam War veterans living in the United States still have not received the practical benefits that we believed this historic legislation was intended to provide.
The Department of Veterans Affairs currently states that it is still reviewing how to implement the VALOR Act and that eligible Korean veterans cannot yet receive VA health care under this authority until that review is completed.
For our aging veterans, continued delay has serious consequences. Many Korean veterans who fought alongside American forces in Vietnam are now in their late seventies and eighties. Some suffer from illnesses and disabilities associated with their wartime service. Time is extremely important to these veterans.
We fully recognize that implementation of the law involves statutory requirements concerning a request from the Republic of Korea and reciprocity arrangements between the two governments. However, we respectfully believe that these administrative and diplomatic issues should not result in an indefinite delay for the veterans whom Congress intended to assist.
We therefore respectfully ask you to:
- Request a formal status report from the Department of Veterans Affairs explaining why implementation of Public Law 118-20 remains incomplete and providing a specific timeline for implementation;
- Encourage the VA, the U.S. Department of State, and the appropriate agencies of the Republic of Korea to resolve any remaining reciprocity, reimbursement, or administrative issues;
- Work with the House Committee on Veterans’ Affairs and other Members of Congress to conduct congressional oversight of the implementation of the Korean American VALOR Act;
- Consider whether additional legislation or administrative action is necessary if the existing reciprocity requirements continue to prevent Korean Vietnam War veterans from receiving meaningful benefits; and
- Meet with representatives of the Korean American Vietnam War Veterans Association SW Region so that we may personally explain the difficulties facing our members and Korean Vietnam War veterans throughout the United States.
Congressman Min, Korean soldiers fought shoulder to shoulder with American servicemembers in Vietnam in defense of the same cause. Many later made the United States their home and became American citizens.
The passage of the Korean American VALOR Act gave these veterans hope that their service and sacrifice would finally receive meaningful recognition. Unfortunately, that promise has yet to become a practical reality.
Because our veterans are aging, we respectfully ask that this matter be treated with urgency.
We would be deeply grateful for your leadership in helping ensure that the Korean American VALOR Act is fully and effectively implemented while the veterans it was intended to help are still able to benefit from it.

재미 베트남 참전용사협회(Korean American Vietnam War Veterans Association) 남서부 지부를 대표하여, 베트남 전쟁 당시 미군과 함께 복무한 한국계 참전용사들에게 여전히 실질적인 혜택이 제공되지 않고 있는 문제와 관련하여 의원님의 협조를 정중히 요청드립니다.
'한국계 참전용사 VALOR 법안(Korean American VALOR Act, H.R. 366)'은 2023년 11월 13일 '공법(Public Law) 118-20'으로 제정되었습니다. 이 획기적인 법안은 베트남에서 복무한 대한민국 국군 참전용사들에게도 미 보훈부(VA)의 특정 의료 혜택을 받을 수 있는 자격을 부여하기 위해 마련되었습니다.
법안이 제정된 지 이미 2년 반이 넘는 시간이 흘렀습니다. 그러나 미국에 거주하는 한국계 베트남 참전용사들은 이 역사적인 법안이 제공하고자 했던 실질적인 혜택을 여전히 받지 못하고 있습니다.
현재 미 보훈부는 VALOR 법안의 시행 방안을 검토 중이며, 해당 검토가 완료되기 전까지는 자격을 갖춘 한국 참전용사들이 이 법안에 따른 보훈부 의료 서비스를 받을 수 없다는 입장을 보이고 있습니다.
고령의 참전용사들에게 이러한 지속적인 지연은 심각한 결과를 초래합니다. 베트남에서 미군과 함께 싸웠던 많은 한국 참전용사들은 현재 70대 후반에서 80대의 고령입니다. 일부는 참전 당시의 복무와 관련된 질병이나 장애로 고통받고 있습니다. 이 참전용사들에게 시간은 무엇보다 중요합니다.
저희는 법안의 시행에 대한민국 정부의 요청 및 양국 정부 간의 상호주의 원칙에 따른 합의 등 법적 요건이 수반된다는 점을 충분히 이해하고 있습니다. 그러나 이러한 행정적, 외교적 사안으로 인해 의회가 지원하고자 했던 참전용사들에 대한 혜택 제공이 무기한 지연되어서는 안 된다고 생각합니다.
이에 다음과 같은 조치를 취해 주시기를 정중히 요청드립니다.
공법 118-20의 시행이 완료되지 않은 이유와 구체적인 시행 일정을 설명하는 공식 현황 보고서를 미 보훈부에 요청해 주십시오.
미 보훈부, 미 국무부, 그리고 대한민국 관련 기관들이 상호주의, 비용 상환 또는 행정적 절차와 관련된 잔여 문제를 해결하도록 독려해 주십시오.
하원 보훈위원회 및 다른 의원들과 협력하여 '한국계 참전용사 VALOR 법안'의 시행 과정에 대한 의회 차원의 감독 활동을 수행해 주십시오. 현행 상호 인정 요건으로 인해 한국계 베트남전 참전 용사들이 실질적인 혜택을 받지 못하는 상황이 지속된다면, 추가적인 입법이나 행정 조치가 필요한지 검토해 주시기 바랍니다.
또한, 한국계 미국인 베트남전 참전 용사 협회 남서부 지역 대표들과 만나 저희 회원들과 미국 전역의 한국계 베트남전 참전 용사들이 겪고 있는 어려움을 직접 설명드릴 수 있도록 해 주십시오.
민 의원님, 한국 군인들은 베트남에서 미군과 어깨를 나란히 하며 같은 대의를 위해 싸웠습니다. 그들 중 많은 이들이 이후 미국에 정착하여 미국 시민이 되었습니다.
한국계 미국인 용사법(Korean American VALOR Act)의 통과는 이들 참전 용사들에게 그들의 헌신과 희생이 마침내 의미 있는 인정을 받을 수 있을 것이라는 희망을 주었습니다. 하지만 안타깝게도 그 약속은 아직 현실로 이루어지지 못했습니다.
참전 용사들의 고령화가 진행되고 있는 만큼, 이 문제를 시급히 처리해 주시기를 간곡히 부탁드립니다.
한국계 미국인 용사법이 제정된 목적대로 혜택을 받을 수 있는 참전 용사들이 있는 동안, 이 법이 완전하고 효과적으로 시행될 수 있도록 의원님의 리더십을 발휘해 주시면 진심으로 감사하겠습니다.
