Immediate Implementation of Public Law 118-20

ISSUE
Public Law 118-20, the Korean American VALOR Act, was signed into law on November 13, 2023. The law amended 38 U.S.C. §109 to provide a pathway to VA health-care eligibility for qualifying veterans who served in the armed forces of the Republic of Korea during the Vietnam War.
Nearly three years after enactment, however, eligible Korean American Vietnam War veterans are still waiting for implementation.
WHY THIS IS URGENT
The affected veterans are an aging population. Many are now in their late seventies, eighties, or older.
Every additional year of delay means that more veterans may pass away before receiving the health-care access Congress intended to provide.
THE PROBLEM
Implementation appears to remain dependent upon unresolved administrative, reimbursement, reciprocity, and/or U.S.–Republic of Korea governmental coordination issues.
Congress has already acted.
The President has signed the legislation into law.
The remaining challenge is administrative implementation.
The veterans who would benefit from this law should not be required to wait indefinitely while governmental agencies resolve implementation details.
REQUESTED ACTION
We respectfully request immediate action to:
- Identify the specific administrative or governmental issues currently preventing implementation of Public Law 118-20.
- Establish a clear implementation timeline for eligible Korean American Vietnam War veterans to apply for and receive VA health-care benefits under the law.
- Direct the Department of Veterans Affairs and other appropriate federal agencies to complete any necessary coordination with the Government of the Republic of Korea without further delay.
- Provide Congress and the affected veteran community with regular progress reports until implementation is completed.
WHY IT MATTERS
Korean soldiers fought alongside American forces during the Vietnam War and made significant sacrifices in support of the United States and its allies.
Many of these veterans later became United States citizens and have lived, worked, paid taxes, and raised their families in this country for decades.
Congress recognized their service by passing the Korean American VALOR Act.
The intent of that law should now be fulfilled through prompt implementation.
CONCLUSION
For these aging veterans, time is not an abstract policy issue.
Time is the issue.
We respectfully urge Congress, the Department of Veterans Affairs, and the Administration to take all necessary steps to implement Public Law 118-20 without further delay.

Public Law 118-20, Korean American VALOR Act는 2023년 11월 13일 대통령의 서명을 거쳐 연방법으로 제정되었습니다.
이 법은 미 연방법 38 U.S.C. §109를 개정하여, 베트남전쟁 당시 대한민국 국군으로 복무한 자격 요건을 충족하는 참전용사들에게 미국 보훈부(VA)의 의료서비스를 받을 수 있는 자격을 부여할 수 있는 법적 통로를 마련하였습니다.
그러나 법이 제정된 지 거의 3년이 되어가는 현재까지도, 자격을 갖춘 한인 월남전 참전용사들은 여전히 이 법의 실질적인 시행을 기다리고 있습니다.
왜 시급한가 (WHY THIS IS URGENT)
이 법의 적용 대상이 되는 참전용사들은 이미 고령층에 속합니다. 많은 참전용사들이 현재 70대 후반, 80대 또는 그 이상의 연령에 이르렀습니다.
시행이 1년씩 더 지연될 때마다, 의회가 법을 통해 제공하고자 했던 의료 혜택을 실제로 받아보지 못한 채 세상을 떠나는 참전용사들이 더욱 늘어날 수 있습니다.
따라서 더 이상의 시행 지연은 이분들에게 매우 중대한 문제입니다.
문제점 (THE PROBLEM)
현재 이 법의 시행은 아직 해결되지 않은 행정적 절차, 비용 상환(reimbursement), 상호주의(reciprocity), 그리고 미국과 대한민국 정부 간의 협의 및 조정 문제 등에 의해 지연되고 있는 것으로 보입니다.
그러나 미 의회는 이미 법안을 통과시켰습니다.
대통령도 이미 법안에 서명했습니다.
Public Law 118-20은 이미 미국의 연방법입니다.
이제 남아 있는 문제는 **법의 실질적인 시행(implementation)**입니다.
요청 사항 (ACTION REQUESTED)
저희는 미 의회가 다음과 같은 조치를 취해 주실 것을 정중히 요청합니다.
- 미국 보훈부(Department of Veterans Affairs)에 대한 공식적인 의회 조사 및 질의(Congressional Inquiry)를 즉시 시작하여, Public Law 118-20의 현재 시행 상황을 확인해 주십시오.
- VA가 이 법을 시행하는 데 아직 남아 있는 모든 법률적, 행정적, 상호주의, 비용 상환 또는 외교적 장애 요인을 구체적으로 밝히도록 요구해 주십시오.
- VA에 **구체적이고 명확한 시행 일정(implementation timetable)**을 제시하도록 요구해 주십시오.
- 미국 보훈부(VA), 미국 국무부(Department of State), 그리고 대한민국 정부의 관련 기관들이 즉각적인 협의와 조정에 착수하도록 촉구해 주십시오.
- 이 법의 시행을 방해하는 법률적 장애가 존재할 경우, 이를 제거하기 위해 추가적인 입법 조치가 필요한지 여부를 검토해 주십시오.
우리의 메시지 (OUR MESSAGE)
대한민국 군인들은 베트남전쟁 당시 미군과 함께 싸웠습니다.
그로부터 50년 이상이 지난 지금, 이 참전용사들이 미 의회가 이미 통과시키고 대통령이 서명한 법률의 시행을 또다시 기다려야 해서는 안 됩니다.
의회는 법을 통과시켰습니다.
대통령은 법에 서명했습니다.
이제 반드시 시행되어야 합니다.
