Dear Congressman Min:
On behalf of The Korean American Vietnam War Veterans Association SW Region, I respectfully request
your direct assistance regarding the continued delay in implementing Public Law 118-20, the Korean
American VALOR Act.
Congress passed H.R. 366 with bipartisan support, and it was signed into law on November 13, 2023. The
legislation was enacted to extend eligibility for Department of Veterans Affairs health care to certain veterans
who served in the armed forces of the Republic of Korea during the Vietnam War, subject to the requirements
established by federal law.
Yet, nearly three years after enactment, eligible Korean American Vietnam War veterans still cannot obtain VA
health-care benefits under this authority.
The Department of Veterans Affairs has publicly stated that it is reviewing how to implement the VALOR Act
and that veterans cannot receive VA health-care benefits under this authority until that review is completed.
For our aging veterans, this continued delay is extremely troubling.
More than 300,000 South Korean troops served in Vietnam alongside American forces. They fought under
dangerous conditions, suffered casualties, and contributed significantly to the allied war effort.
Many Korean Vietnam War veterans living in the United States are now in their late seventies, eighties, or older.
They cannot afford to wait indefinitely for administrative and diplomatic issues to be resolved.

Congress has acted. The President has signed the legislation. Public Law 118-20 is already federal law.
What is now urgently needed is implementation.
We understand that issues involving reciprocity, reimbursement, and coordination between the United States
and the Republic of Korea may remain. However, nearly three years after enactment, affected veterans deserve
a clear explanation of what specifically remains unresolved and when those issues will be resolved.
Therefore, Congressman Min, we respectfully ask you to initiate a formal Congressional Inquiry with the
Department of Veterans Affairs regarding Public Law 118-20 and request written answers to the following
questions:
1. What specific legal, administrative, diplomatic, or reimbursement requirements are currently preventing
implementation of Public Law 118-20?
2. What actions has the Department of Veterans Affairs taken since November 13, 2023, to implement the
Korean American VALOR Act?
3. Has the VA formally communicated or negotiated with the government of the Republic of Korea
concerning reciprocity or reimbursement requirements under 38 U.S.C. §109?
4. If such discussions have occurred, what issues remain unresolved?
5. Which U.S. federal agencies and Republic of Korea agencies are responsible for resolving those
remaining issues?
6. What specific steps must still be completed before eligible Korean American Vietnam War veterans may
enroll in VA health care under Public Law 118-20?
7. What is the VA's anticipated timetable for completing implementation and beginning enrollment of
eligible veterans?
8. If existing statutory requirements are preventing implementation, does the VA recommend additional
congressional legislation to remove or modify those barriers?
We also respectfully request that your office encourage direct coordination among the Department of Veterans
Affairs, Department of State, and appropriate officials of the Republic of Korea to resolve any outstanding
reciprocity or reimbursement issues without further unnecessary delay.
If the existing language of 38 U.S.C. §109 makes implementation impractical, we respectfully ask you to
consider supporting or introducing corrective legislation that would allow Congress's original intent to be
fulfilled.
This is becoming increasingly urgent because of the age of the affected veterans.
Every additional year of delay means that more Korean Vietnam War veterans will pass away without ever
receiving the health-care access that Congress intended to provide.
These veterans fought beside American soldiers more than fifty years ago. They have already waited long
enough.
We respectfully ask for your leadership in obtaining a definitive response from the Department of Veterans
Affairs and in helping bring Public Law 118-20 from enacted legislation to meaningful benefits for the veterans
it was intended to serve.
We would greatly appreciate a written response from your office regarding the results of the Congressional
Inquiry and any actions you believe Congress can take to expedite implementation.

의회는 초당적 지지로 H.R. 366 법안을 통과시켰고, 2023년 11월 13일 법으로 제정되었습니다.
이 법안은 베트남 전쟁 당시 대한민국 국군에서 복무한 특정 재향 군인들에게 미 재향 군인부(VA) 의료 혜택을 확대하기 위해 제정되었으며,
연방 법률에서 정한 요건을 충족해야 합니다.
하지만 법안 제정 후 거의 3년이 지난 지금도, 자격을 갖춘 한국계 미국인 베트남 전쟁 참전 용사들은 여전히 ​​이 법에 따른 VA 의료 혜택을 받지 못하고 있습니다.
미 재향 군인부는 VALOR 법 시행 방안을 검토 중이며,
검토가 완료될 때까지 재향 군인들은 이 법에 따른 VA 의료 혜택을 받을 수 없다고 공개적으로 밝혔습니다.
고령의 재향 군인들에게 이러한 지속적인 지연은 매우 우려스러운 일입니다.

보훈부에 공식적인 의회 조사를 요청하고 다음 질문에 대한 서면 답변을 요구해 주시기를 정중히 요청드립니다.
1. 현재 공법 118-20의 시행을 막고 있는 구체적인 법적, 행정적, 외교적 또는 보상 요건은 무엇입니까?

2. 미 재향군인부(VA)는 2023년 11월 13일 이후 한국계 미국인 참전용사법(Korean American VALOR Act) 시행을 위해 어떤 조치를 취했습니까?

3. VA는 대한민국 정부와 38 U.S.C. §109에 따른 상호 인정 또는 상환 요건과 관련하여 공식적으로 소통하거나 협상했습니까?

4. 그러한 논의가 있었다면, 어떤 문제가 아직 해결되지 않았습니까?

5. 어떤 미국 연방 기관과 대한민국 정부 기관이 이러한 문제를 해결할 책임이 있습니까?

또한, 보훈부, 국무부, 그리고 대한민국 관련 공무원 간의 직접적인 협력을 장려하여, 불필요한 지연 없이 모든 미해결된 상호 인정 또는 상환 문제를 해결해 주시기를 정중히 요청드립니다.
만약 38 U.S.C. §109의 현행 조항으로 인해 시행이 비현실적이라면, 의회의 원래 의도가 실현될 수 있도록 시정 법안을 지지하거나 발의해 주시기를 정중히 요청드립니다.

영향을 받는 참전용사들의 고령화로 인해 이 문제는 더욱 시급해지고 있습니다.
매년 지연될 때마다 더 많은 한국-베트남 전쟁 참전용사들이 의회가 제공하고자 했던 의료 혜택을 받지 못한 채 세상을 떠나게 될 것입니다.

이 참전용사들은 50여 년 전 미군과 함께 싸웠습니다. 그들은 이미 충분히 오래 기다렸습니다.

저희는 귀하께서 보훈부로부터 명확한 답변을 얻어내시고, 공법 118-20이 제정되어 그 취지에 부합하는 참전 용사들에게 실질적인 혜택을 제공할 수 있도록 지도해 주시기를 간곡히 요청드립니다.
의회 조사 결과와 공법 시행을 신속하게 진행하기 위해 의회가 취할 수 있는 조치에 대한 귀하의 서면 답변을 기다리겠습니다.
귀하의 헌신적인 노력과 참전용사 및 한인 사회에 대한 지속적인 지원에 감사드립니다.
